TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the website dumpsterkingllc.com and the dumpster rental services provided by Dumpster King, LLC ("Dumpster King," "we," "us," or "our"). By placing an order, requesting a quote, or using our website or services, you agree to these Terms. If you do not agree, do not use our services.

1. WHO WE ARE
Dumpster King, LLC provides roll-off dumpster rentals to customers in Des Moines and surrounding Iowa communities. Contact: dumpsterkingllc@gmail.com, (515) 988-2454, 1617 S Ankeny Blvd, Ankeny, IA 50023.

2. SERVICE DESCRIPTION
We rent temporary roll-off dumpsters for residential, commercial, and construction use subject to availability. Each rental includes delivery, placement at a site you control, a rental period, and removal. Weight limits, material restrictions, and site conditions apply.

3. ELIGIBILITY AND AUTHORITY
You must be at least 18 and legally capable of entering into contracts. If you order on behalf of a company, you represent that you have authority to bind that company to these Terms.

4. QUOTES, ORDERS, PRICING, AND TAXES
• Quotes are estimates based on information you provide and are subject to verification.
• Prices may vary by size, location, rental length, disposal facility fees, and fuel or regulatory surcharges.
• Applicable taxes and government fees are additional.
• We may refuse or cancel any order for valid reasons, including site inaccessibility, unsafe conditions, or prohibited materials.

5. PAYMENT TERMS
• Unless otherwise stated in writing, payment is due before or at delivery.
• You authorize us to charge your provided payment method for rental fees, overages, trip or wait fees, contamination fees, and taxes.
• Unpaid balances may accrue late fees as permitted by law and you are responsible for reasonable collection costs and attorney fees.

6. DELIVERY WINDOW, ACCESS, AND SITE PREPARATION
• Delivery and pickup occur within a service window. Exact times are not guaranteed.
• You must provide clear and safe access for our trucks on paved or compacted surfaces and ensure adequate overhead clearance.
• You must mark underground utilities and instruct our driver where to place the dumpster. We may refuse placement that appears unsafe.

7. PROPERTY CONDITION AND DAMAGE WAIVER
Heavy trucks and containers can scratch, crack, rut, or otherwise damage surfaces, driveways, curbs, lawns, irrigation, or underground utilities. You accept the risk of surface damage from ordinary operations and agree that we are not liable for cosmetic or surface damage resulting from reasonable placement and retrieval on areas you designate. We are not responsible for pre-existing conditions or concealed defects.

8. PEMRITS AND COMPLIANCE
You are responsible for obtaining any required permits, permissions, or right-of-way approvals and for compliance with applicable laws, HOA rules, and municipal ordinances including street placement and time limits.

9. LOADING RULES, PROHIBITED MATERIALS, AND WEIGHT LIMIT
• Load materials evenly and do not exceed the top rail. Overfilled loads cannot be hauled and may incur trip or wait fees.
• Do not place liquids or items that may leak. Keep lids closed where applicable.
• Prohibited items include hazardous or toxic waste, liquids, paint, oils, fuels, solvents, batteries, tires, asbestos, medical waste, refrigerants, mattresses where prohibited by local transfer stations, electronics where restricted, and any materials restricted by the receiving landfill or law.
• You are responsible for the contents of the dumpster. You agree to pay all overage charges for exceeding stated weight limits and any fees or fines charged by disposal facilities due to contamination or prohibited materials.

10. TITLE, RISK OF LOSS, AND ABANDONMENT
Title to the container remains with Dumpster King at all times. Title to the waste transfers to us only upon lawful pickup and acceptance at a disposal facility. If we cannot access or remove a dumpster due to your acts or omissions, you may incur additional rental or trip fees. We may treat contents as abandoned if you fail to schedule pickup at the end of the rental period.

11. SERVICE INTERRUPTIONS AND FORCE MAJEURE
We are not liable for delays or failures caused by events beyond our reasonable control, including severe weather, road closures, strikes, accidents, equipment breakdowns despite reasonable maintenance, shortages, or governmental actions.

12. WEBSITE USE AND ACCEPTABLE USE
• You will not attempt to interfere with site operation or security or use automated means to access the site without permission.
• You will not submit unlawful, infringing, or deceptive content.
• We may suspend access for misuse or to protect the site or our services.

13.USER CONTENT AND REVIEWS
If you submit reviews, messages, photos, or other content, you grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content for marketing and service purposes, subject to applicable law and our Privacy Policy.

14. INTELLECTUAL PROPERTY
All website content, logos, text, graphics, and software are the property of Dumpster King or its licensors and are protected by law. You may not copy, modify, or create derivative works without permission.

15. SMS, EMAIL, AND ELECTRONIC COMMUNICATIONS
By providing a phone number or email, you consent to receive service-related messages about scheduling, delivery, pickup, or account matters. Marketing messages will be sent only as permitted by law and you can opt out at any time. Standard message and data rates may apply.

16.DISCLAIMERS
Except as expressly stated, the services and website are provided on an "as is" and "as available" basis. We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement. Some jurisdictions do not allow disclaimers of implied warranties, so these may not apply to you.

17. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Dumpster King will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising out of or related to these Terms or your use of the services. Our total liability for any claim will not exceed the amounts you paid for the applicable rental in the three months preceding the event giving rise to the claim.

18. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Dumpster King and its owners, employees, and contractors from and against claims, damages, liabilities, costs, and expenses arising from your breach of these Terms, your misuse of the services, violation of law, or placement of prohibited materials.

19. DISPUTE RESOLUTION AND GOVERNING LAW
These Terms are governed by the laws of the State of Iowa without regard to conflict of laws rules. Before filing a lawsuit, the parties will attempt in good faith to resolve disputes through informal discussions for at least 30 days after written notice. Either party may bring claims in small claims court where jurisdiction and venue are proper. If a court finds any provision unenforceable, the remaining provisions will remain in effect.

20. CHANGES TO THE SERVICES OR TERMS
We may update the website, pricing, or policies from time to time. We may modify these Terms by posting an updated version with a new effective date. Your continued use after changes become effective means you accept the revised Terms.

21. TERMINATION
We may suspend or terminate access to the website or decline or cancel services where necessary to protect safety, comply with law, or for nonpayment. You remain responsible for fees incurred before termination and for retrieval of our container.

22. ENTIRE AGREEMENT AND CONTACT
